Malta Unveils Sweeping Labour Reform to Standardise Rights and Modernise Work Conditions

Workers across Malta are on the brink of a major shift in employment rights, as the government rolls out a comprehensive overhaul of labour legislation aimed at closing long-standing gaps and aligning protections with today’s realities.

Described as “historic” by Parliamentary Secretary Andy Ellul, the reform package will update 32 Wage Regulation Orders (WROs), many of which have remained largely unchanged for decades. The initiative reflects a broader push by authorities to modernise labour frameworks in response to evolving industries, workforce expectations, and the rise of non-traditional employment.

At the heart of the reform is a long-awaited change: workers will now be entitled to paid sick leave from their very first day on the job. Previously, eligibility varied widely depending on the sector—some employees had to wait months or even a full year. By standardising this right, the government aims to eliminate inequality between workers performing similar roles under different conditions.

The reform also introduces uniformity in personal leave entitlements. All employees will now receive three days of bereavement leave and three days of marriage leave, replacing a fragmented system where such benefits depended heavily on industry-specific rules. This move brings Malta more in line with broader European labour standards, where consistency and predictability are increasingly prioritised.

Another notable shift addresses age-based wage discrepancies. Until now, younger workers—particularly those aged 16 and 17—could legally be paid less than adults for comparable work. Under the new framework, equal pay regardless of age will become the norm within the affected sectors, reinforcing principles of fairness and non-discrimination.

Employers, meanwhile, will face clearer obligations. Companies will be required to provide uniforms and essential protective gear at no cost to employees, a measure that strengthens workplace safety while reducing out-of-pocket expenses for workers, particularly in physically demanding industries.

The scope of these reforms is broad, covering sectors such as construction, hospitality, transport, security, textiles, and even emerging areas like platform-based and gig economy work. This inclusion signals recognition of shifting employment patterns—something officials say was largely absent when many of the original regulations were drafted.

According to Diane Vella Muscat, Director General of the Department of Industrial and Employment Relations, the changes are the product of extensive consultation with social partners, including unions and employer representatives. She emphasised that beyond strengthening protections, the reforms will also bring much-needed clarity to businesses navigating a patchwork of outdated rules.

The overhaul comes amid wider discussions in Malta about workforce sustainability, cost-of-living pressures, and the need to attract and retain talent in a competitive European market. In recent years, policymakers have faced growing calls to address precarious work arrangements and ensure that economic growth translates into improved quality of life for employees.

By standardising rights and updating legislation to reflect modern employment realities, the government is positioning these reforms as a foundational step toward a more balanced labour market—one that protects workers while offering employers a clearer, more predictable regulatory environment.
